Terms of service

Draft for legal review. This document has not yet been approved by counsel and is not binding until it is.

These terms apply to your use of the CloudVision360 and ITOps360 services (“Services”). The Services are provided by CloudOne Technologies (SMC-Private) Limited (“we”, “us”), the company behind the CloudVision360 brand. If you have signed an order form or master agreement with us, that agreement takes precedence where it conflicts with these terms.

1. Accounts

You must provide accurate information, keep credentials confidential, and enable multi-factor authentication for administrators. You are responsible for activity in your accounts and for the users you invite.

2. Your data

You keep all rights to the data you or your systems provide to the Services (“Customer Data”). You grant us the rights needed to provide, secure and support the Services. We process personal data in Customer Data under our data processing agreement.

3. Access you grant to your systems

You decide which systems the Services connect to and which permissions they receive. Remediation and automation run only with permissions you grant and under the policies you configure. You are responsible for reviewing and approving changes that your policies require a person to approve. Some actions can’t be undone, such as wiping a computer; the Services ask for approvals and confirmation, but you are responsible for confirming that the action and its target are correct before approving.

4. Acceptable use

You must follow our acceptable use policy. You may connect only systems you are authorized to manage.

5. AI features

AI features are optional and governed by your tenant settings and our AI usage policy. AI output can be wrong; it is provided to assist your decisions, not to replace them.

6. Availability and support

We provide the Services with commercially reasonable care. Service levels and support terms are set out in your order form.

7. Fees

Fees, billing periods and usage-based charges are set out in your order form. Usage such as AI tokens is metered as described in your plan.

8. Confidentiality and security

Each party protects the other’s confidential information. We maintain the security controls described in our Trust Center.

9. Warranties and liability

Except as stated in your order form, the Services are provided “as is”. Each party’s liability is limited as set out in your order form or, if none, to the fees paid in the twelve months before the claim.

10. Term and termination

Either party may terminate for material breach not cured within 30 days. On termination you can export your data for 30 days, after which we delete it as described in Data handling.

11. Changes

We may update these terms with notice. Material changes take effect at your next renewal unless required sooner by law.

12. Governing law

These terms are governed by the laws of the Islamic Republic of Pakistan, and the courts of Pakistan have jurisdiction over any dispute, except where your order form names a different governing law and courts, which then take precedence.
